By using Hostcarts Cloud Services website hosting services (“Services”), you agree to the terms of this Service Level Agreement (“Agreement”). This Agreement is between you (the “Client”) and Hostcarts Cloud Services .
Your continued use of the Services constitutes acceptance of all terms herein.

Clients must not use system resources in a manner that negatively impacts other customers. Excessive CPU, bandwidth, or disk usage may result in throttling, suspension, or termination.

Scripts or applications consuming undue CPU time may be reprioritized or disabled. Continued misuse constitutes server abuse.

Running background processes without written approval from Hostcarts is prohibited.

Hosting adult content is strictly prohibited, except softcore erotic art with prior written permission.
“Hostcarts Cloud Services prohibits the storage and transmission… of pornography… Written permission must be obtained…”
Warez, copyrighted software, destructive applications, hacking/cracking content, and similar materials are strictly forbidden.
Unsolicited commercial email (spam) is strictly prohibited and grounds for immediate termination.
“Unsolicited Commercial Email ['Spam'] is implicitly forbidden.”
Clients may not resell any part of the Services free of charge.
File hosting, MP3/video hosting, download‑centric sites, and hotlinking bandwidth for external sites are not permitted.
Hostcarts Cloud Services may modify this Agreement with 30 days’ notice. Continued use of the Services constitutes acceptance of updated terms.
“Modifications… will become effective 30 days after the modifications are posted.”
Charges may appear under a descriptor different from “Hostcarts Cloud Services.” Chargebacks are considered a material breach and may result in suspension.

Services renew automatically unless cancelled through the Services Interface.
Refunds for duplicate payments may take 7–10 days.
Clients may not downgrade below their actual usage levels.
Hostcarts Cloud Services may suspend or terminate Services for violations of this Agreement. No refunds will be issued for terminations due to misuse.
“Your use of the Services may be suspended and/or this Agreement may be terminated if we determine that you are… violating the terms…”
Hostcarts Cloud Services may also terminate without cause with 30 days’ notice and refund unused fees.
Clients are solely responsible for backing up their data. Hostcarts Cloud Services is not obligated to return data upon termination.

Unplanned interruptions exceeding 24 hours within a 30‑day period qualify for service credits equal to 24 hours of hosting per affected period.
“Exclusive remedy shall be a credit toward 24 hours of hosting…”
Hostcarts Cloud Services’ maximum liability shall not exceed the fees paid for one month of Services, capped at $100.

Clients agree to indemnify Hostcarts against all third‑party claims arising from misuse, violations, or infringement.
Services are provided “as‑is” without warranties of any kind, except where legally non‑excludable.
